So if anyone here has legal experience with this situation I have a question..... One of the cops taking the police report remarked about the other driver's lack of coherency, that he didn't know where he was or that he was in a crash, that he would probably lose his driver's license. If it comes out that he should not have been driving in the first place, would that be grounds for pressing charges against the family??

First off, Im saddened to hear about all of this because I know how much you like your car. Ive PMd you my phone number in case you want to talk about this in greater detail.

Your argument does have some merit but I doubt youd be successful suing his family; they werent there and they didnt cause the crash. Itd be like suing the DMV for issuing him a driving license in the first place. You could always sue this guy directly (named defendant, not a doe 1 through 10) but youll need an attorney so start shopping around right now. If I was still in the game I might have a referral or two for you but Im not so I dont, sorry. Also, the civil courts take forever so be prepared for that.

What is the point of trying to sue? Traffic accidents happen all the time. Maybe he was distracted by a cat running across the road. Just go through insurance and be done.

Got your pm, thank you Jon. I see your point about the family not being responsible... also the DMV argument is valid. However what I was getting to is that if this guy is to the age where it is a hazard for him to be on the road with others, then there is some gross negligence that needs to be rectified...... I guess there's not really anything to be done except hope the cop was right about him losing his driving privileges. That shit is whack! lol

also zoey= totalled, just got done with insurance. USAA is the best!!!

I'd love to go with USAA for my car insurance. Trouble is, they insist on raping me with premiums. I have a clean driving record, I'm 26, and live in a low crime/accident area. Geico and Progressive will give me coverage for my GTO and Grand Prix at 73 a month, I forgot what limits. USAA for the same limits wants 156 a month. They may have better service, but I'll be damned if I'm gonna pay 1000 more a year for the same coverage.
